Terms of Use

These Terms of Use (“Terms”) govern your use of the Memoria mobile application (“App”, “Service”). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Description of the Service

Memoria is a digital platform that allows users to:

• create personal profiles
• create and manage family trees
• write biographies and life stories
• upload and store text, photos, and audio content
• convert audio to text
• use AI-assisted tools to improve or format content
• create memorial pages
• communicate with other users
• control visibility and editing permissions for profiles and family trees

The Service is intended for personal, non-commercial use only.

2. Eligibility

You must be at least 13 years old to use the Service. Parents or legal guardians are responsible for any content added about minors.

3. User Account

You may create an account using:

• email
• Google account
• Apple ID

You are responsible for:

• maintaining the confidentiality of your login credentials
• all activities performed under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Profiles & Required Information

To use the Service, certain information is required:

• first and last name (required)
• country of birth (required)
• city of birth (required)
• profile photo (optional)
• date of birth (optional)

You may edit your profile information after registration.

5. User Content

You retain all rights to the content you create (“User Content”). By uploading User Content, you grant Memoria a non-exclusive, revocable, worldwide license to store, display, and process such content solely for the purpose of providing the Service.

You are responsible for ensuring that your content:

• does not violate copyright or intellectual property rights
• does not violate privacy or personal rights of others
• is lawful and not harmful or abusive

You confirm that you have the right to publish content related to other individuals, including living persons and deceased persons. You may delete your content at any time.

6. Family Members & Third-Party Profiles

You may create pages for family members, including children and other individuals. Memoria does not verify the accuracy of such information. If a person believes their data has been added without proper authorization, they may contact support to request review or removal.

7. Messaging

Users may exchange messages within the App. Memoria does not moderate messages and is not responsible for the content of user communications. All messages are deleted for all participants when a user deletes their account.

8. Privacy & Access Controls

You can control who can:

• view your profile
• view your family tree
• edit family members

Visibility options include:

• everyone within the App
• connected family members
• only you

All content is accessible only to authenticated users.

9. AI Features

Memoria uses AI tools powered by OpenAI. AI features:

• are activated only by your explicit request
• may temporarily process content using third-party AI providers
• are used to improve text or convert audio to text

Audio files are deleted after transcription.

Memoria does not use User Content to train AI models.

10. Subscriptions & Payments

The Service may currently be offered free of charge. In the future, certain features (including AI tools, storage limits, or advanced functionality) may require payment through subscriptions or one-time purchases. Any paid features will be clearly disclosed before purchase and will be governed by the billing rules of the Apple App Store or Google Play Store.

11. Data Storage & Availability

The Service is provided “as is” and “as available”. We do not guarantee uninterrupted operation, error-free performance, or permanent availability of content. Features may be modified or discontinued at any time.

12. Account Deletion

You may delete your account at any time via the App.

After deletion:

• most of your content is permanently removed
• all messages are deleted for all participants
• backup copies may be retained for up to 30 days for technical or legal reasons

13. Disclaimer & Limitation of Liability

To the maximum extent permitted by law, Memoria shall not be liable for:

• loss of data
• loss of access
• emotional distress
• indirect or incidental damages

Use of the Service is at your own risk.

14. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via the App or email. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Ukraine.

Ці Умови користування (“Умови”) регулюють використання мобільного застосунку Memoria (“Застосунок”, “Сервіс”). Користуючись Застосунком або створюючи акаунт, ви погоджуєтеся з цими Умовами. Якщо ви не згодні — будь ласка, не використовуйте Сервіс.

1. Опис сервісу

Memoria — це цифрова платформа, яка дозволяє:

• створювати особисті профілі
• формувати сімейні дерева
• писати біографії та життєві історії
• завантажувати текст, фото та аудіо
• перетворювати аудіо в текст
• використовувати інструменти ШІ для покращення контенту
• створювати меморіальні сторінки
• обмінюватися повідомленнями з іншими користувачами
• керувати доступом до профілю та сімейного дерева

Сервіс призначений виключно для особистого, некомерційного використання.

2. Хто може користуватися

Користуватися Сервісом можуть особи віком від 13 років. Батьки або законні опікуни несуть відповідальність за контент, доданий щодо неповнолітніх.

3. Акаунт користувача

Реєстрація можлива через:

• email
• Google
• Apple ID

Ви відповідаєте за:

• збереження даних входу
• всі дії, виконані у вашому акаунті

Ми залишаємо за собою право блокувати акаунти, що порушують Умови.

4. Профіль користувача

Для використання Сервісу необхідно вказати:

• імʼя та прізвище (обовʼязково)
• країну народження (обовʼязково)
• місто народження (обовʼязково)
• фото профілю (необовʼязково)
• дату народження (необовʼязково)

Дані профілю можна змінювати після реєстрації.

5. Контент користувача

Усі права на створений вами контент (“Контент користувача”) залишаються за вами. Завантажуючи контент, ви надаєте Memoria невиключну, відкличну, глобальну ліцензію на його зберігання та обробку з метою надання Сервісу.

Ви гарантуєте, що:

• маєте право публікувати цей контент
• контент не порушує авторські чи особисті права інших осіб
• контент є законним і не завдає шкоди

Ви підтверджуєте право публікувати інформацію про інших осіб, включно з живими та померлими.

6. Родичі та треті особи

Користувач може створювати сторінки родичів, включно з дітьми. Memoria не перевіряє достовірність таких даних. Особа, яка вважає, що її дані були додані без згоди, може звернутися до служби підтримки.

7. Повідомлення

Користувачі можуть обмінюватися повідомленнями у Застосунку. Memoria не здійснює модерацію повідомлень і не несе відповідальності за їх зміст. Після видалення акаунта всі повідомлення видаляються для всіх учасників.

8. Приватність і доступ

Ви можете визначати, хто може:

• переглядати ваш профіль
• переглядати сімейне дерево
• редагувати родичів

Доступ мають лише авторизовані користувачі.

9. Функції ШІ

Memoria використовує інструменти ШІ на базі OpenAI. ШІ:

• активується лише за вашим запитом
• може тимчасово обробляти дані сторонніми сервісами
• використовується для редагування тексту та транскрипції аудіо

Аудіофайли видаляються після обробки.

Контент не використовується для навчання моделей ШІ.

10. Платні функції

На даний момент Сервіс може бути безкоштовним. У майбутньому окремі функції можуть стати платними (підписки або разові покупки). Умови оплати будуть повідомлені заздалегідь та регулюватимуться правилами App Store або Google Play.

11. Доступність сервісу

Сервіс надається “як є”. Memoria не гарантує безперервну або безпомилкову роботу та може змінювати функціонал у будь-який момент.

12. Видалення акаунта

Користувач може видалити акаунт у будь-який час.

Після видалення:

• більшість даних видаляється остаточно
• повідомлення зникають у всіх учасників
• резервні копії можуть зберігатися до 30 днів

13. Обмеження відповідальності

Memoria не несе відповідальності за:

• втрату даних
• втрату доступу
• емоційний дискомфорт
• непрямі або випадкові збитки

Використання Сервісу здійснюється на ваш власний ризик.

14. Зміни до Умов

Ми можемо оновлювати Умови. Подальше користування Сервісом означає згоду з оновленнями.

15. Застосовне право

Ці Умови регулюються законодавством України.
